Additional Conditions for Access to the Sites

Information on the Sites is provided and made available by PHS solely as a convenience and PHS has and assumes no obligation to continue to make the Sites available or to grant access to any person who fails to comply with the terms and conditions for use of the Sites. PHS may also make improvements and/or changes in the products and/or programs described in this information at any time without notice. If PHS determines, in its sole discretion, that you have not complied with any term or condition required for use of the Sites, it may terminate your access to the Sites and any services provided by the Sites without prior notice. Such action removes your authorization to access or use the Sites and requires you to destroy all electronic or other materials and copies of such materials obtained from the Sites, but you will still be bound by the agreements and warranties made by you, and by the disclaimers and limitations of relating to use of the Sites.

You agree to inform PHS immediately of any change in your employment or other status, which results in your no longer having a reason to access the information available on the Sites. In addition, if access to the Sites is granted to an employee or independent contractor pursuant to the employee's or contractor's relationship with an employer, the employer agrees that it will immediately inform PHS of the termination of all such relationships so that PHS may deny access to the Sites for such terminated individuals.

Products and Services Offerings

The Sites may highlight PHS's health products and services. The product and/or services descriptions, if any, provided on the Sites are not intended to constitute offers to sell or solicitations in connection with any product or service. All products are not available in all areas and are subject to applicable regulation areas and in many instances may be offered only through employers or other plan sponsors. Specific products may not be available in both self-funded and insured forms. Covered services and preferred benefits are provided under the terms of the applicable plan contract, including limitations and exclusions. Anyone interested in a particular product should contact PHS to determine whether the product and/or service is available in their jurisdiction, and to request a copy of the applicable policy for a complete description of the product and/or service in question.

By signing up for electronic communications it is understood that you grant express permission to Presbyterian Healthcare Services and/ or Presbyterian Health Plan or any agent acting on their behalf to communicate with you via any electronic mail addresses and any phone numbers that have been provided, including cellular/wireless devices, through means of individual or automatically generated electronic mail, person to person phone calls, automated phone calls and automatically generated text messaging. Message and data rates may apply.

When you sign up for text messages from Presbyterian Healthcare Services, you are signing up to receive text messages related to your relationship with Presbyterian Healthcare Services, including updates related to your visits, MyChart account, one-time passcode, billing notifications, prescription reminders, and care management. You can opt-out of SMS messages by texting STOP to 31082. Your opt-out request will generate one final message confirming that you have been unsubscribed. You will no longer receive SMS messages from 31082. If you want to join again, sign up using MyChart or text HELP to 31082 for instructions. Trademarks and Intellectual Property Rights

All service-marked, trademarked, and registered items are the sole and exclusive property of PHS unless otherwise noted. All rights are reserved. Downloads, copies, or mirrors of the Sites are forbidden without prior consent from PHS; this does not apply to the various forms and documents available in PDF format on the Sites which are specifically designated for users.

Not a Solicitation

Nothing in the Sites should be construed as a solicitation or offer to purchase coverage, services, or products from PHS or any of its affiliated companies.

Not a Substitute for Professional Healthcare or Advice

The information contained in the Sites is general in nature and is not a substitute for professional healthcare. It is not meant to replace the advice of healthcare professionals. Accessing the Sites and Account Security

We reserve the right to withdraw or amend the Sites, and any service or material we provide on the Sites, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Sites is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Sites, or the entirety of the Sites. We reserve the right to suspend, discontinue or deny your access to and use of the Sites for any lawful reason.

You are responsible for making all arrangements necessary for you to have access to the Sites. Our services are accessed remotely using the internet, data networks, and devices which can access the internet, and which can operate the Sites and our website (“Infrastructure”). We make the Sites and our website available for access using Infrastructure but are not responsible for Infrastructure ourselves. The Sites operate a PC or Laptop or mobile device with a current released version of Google Chrome, and at least 1 prior released version. PHS reserves the right to update the iOS and Android versions supported, and to discontinue supporting older versions of iOS or Android, at any time. The Sites require a consistent 4G or faster data connection and do not operate reliably on 3G, GPRS or EDGE connections. If you wish to use the Sites, you should ensure you have an internet-enabled device and a sufficient internet connection available. You acknowledge that technical or security threats or issues affecting the Infrastructure may require us to suspend our services in order to ensure they are secure or operating optimally.

You are responsible for ensuring the security of the Infrastructure you use to access the Sites. We strongly recommend that if you are using a wireless network to access the Sites, you avoid use of public wi-fi facilities in favor of a personal wi-fi connection, and that the wireless network is secured with at least WPA-2 security. We recommend that the device from which you access the App is password protected, set to lock after a short period of inactivity, and protected with suitable security features.

From time to time, updates to the Sites may be made available to you. We recommend that you use the latest version of the App at all times, to take advantage of the latest enhancements and important updates. Depending on the update, you may not be able to use the App until you have downloaded the latest version of the App and accepted any updated Terms of Use.

To access the Sites, App, or some of the resources they offer, you may be asked to provide certain registration details or other information. It is a condition of your use of the Sites that all the required information you provide on the Sites is correct, current, and complete. We may contact you by telephone, mail, or email to verify your myPRES account information. We may request further information from you, and you agree to provide such further information to ensure the validity of your account.

If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to the Sites or portions of it using your user name, password, or other security information. You agree to notify us promptly of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared device so that others are not able to view or record your password or other personal information.

iOS Biometric Authentication

You can use Touch ID® or Face ID® to log in to the App instead of your user ID and password. You must agree to the terms and conditions on your personal device to enable Touch ID or Face ID. Please ensure that Touch ID or Face ID is also enabled on your device in order to enable it for the App.

You acknowledge and agree that anyone with saved biometric information on your device will have authority to access your PHS account and will be authorized to initiate transactions through the App.

PHS ADVISES YOU TO REVIEW AND CONFIRM THAT ALL REGISTERED BIOMETRIC INFORMATION BELONGS TO INDIVIDUALS WITH AUTHORITY TO INITIATE TRANSACTIONS ACCESSED THROUGH THE APP. BY USE OF THE APP, PHS ACCEPTS YOUR REPRESENTATION THAT ANYONE WITH REGISTERED BIOMETRIC INFORMATION IS AUTHORIZED TO VIEW INFORMATION AND TRANSACT ON THE APP.

PHS does not provide the Touch ID or Face ID technology and does not save or access your biometric information.

PHS does not save your myPRES password to your device.

Android Biometric Authentication

You can use Fingerprint to log in to the App instead of your user ID and password. You must agree to the terms and conditions on your personal device to enable Fingerprint. Please ensure that Fingerprint is also enabled on your device in order to enable it for the App.

You acknowledge and agree that anyone with fingerprints saved on your device will have authority to access the App and will be authorized to initiate transactions through the App.

PHS ADVISES YOU TO REVIEW AND CONFIRM THAT ALL REGISTERED BIOMETRIC INFORMATION BELONGS TO INDIVIDUALS WITH AUTHORITY TO INITIATE TRANSACTIONS ACCESSED THROUGH THE APP. BY USE OF THE APP, PHS ACCEPTS YOUR REPRESENTATION THAT ANYONE WITH REGISTERED BIOMETRIC INFORMATION IS AUTHORIZED TO VIEW INFORMATION AND TRANSACT ON THE APP.

PHS does not provide the Fingerprint technology and does not save or access your fingerprints.

PHS does not save your myPRES password to your device.

PHS has the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms of Use.

Laws and Regulations

Access to and use of the Sites are subject to applicable federal, state, and local laws and regulations.

Forum Selection and Litigation

Use of the Sites shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflicts of law provisions. You agree to submit to the personal jurisdiction of the courts of the State of New Mexico for any cause of action arising out of this Agreement. If a court deems any part of this Agreement invalid, the remaining parts shall remain in full force and effect. You agree to file any cause of action with respect to this Agreement and your rights and obligations in the State of New Mexico within one year after the cause of action. You agree that a cause of action filed after this date is barred.

Web Privacy

PHS works to protect the Sites. Although we always try to use the most up-to-date encryption technology, please be aware that unauthorized third parties could obtain illegal access to the Sites.

PHS routinely gathers data on the Sites usage, such as how many people visit the Sites, the sections they visit, what time they visit, how long they stay, etc.

We use third-party advertising companies to serve ads on sites which we advertise with. Third-party advertising technology:

  • Uses information derived from your visits to the Sites and the sites on which we advertise to serve ads to you;

  • Places a unique third-party cookie or cookies on your browser;

  • In addition, we may use Web beacons, provided by third-party advertising companies, to help manage and optimize our online advertising. Web beacons enable us to recognize a browser's cookie when a browser visits the Sites, and to learn which banner ads bring users to the Sites.
